These Terms & Conditions ("Terms") govern the purchase, booking, access, and use of services provided by THE CAMP CHIANG MAI COMPANY LIMITED, trading as "The Camp" ("The Camp", "we", "us", or "our").

By making a booking, purchasing a service, creating an account, checking in, participating in training, using our facilities, or otherwise accepting these Terms electronically or in writing, you ("Customer", "Participant", "Guest", "Member", "you", or "your") acknowledge that you have read, understood, and agreed to these Terms.

These Terms apply together with any applicable booking confirmation, product-specific written terms, Training Waiver, Assumption of Risk, Release of Liability & Code of Conduct ("Waiver"), Privacy Policy, rules communicated for accommodation or facility use, visa-program terms where applicable, and other written policies expressly applicable to the service purchased.

Nothing in these Terms excludes, restricts, waives, or overrides any right or liability that cannot legally be excluded, restricted, waived, or overridden under the laws of the Kingdom of Thailand.
 

1. ABOUT THE CAMP AND SCOPE OF SERVICES

The Camp may provide services including:

  • Muay Thai training.

  • Group training.

  • Private Sessions.

  • Kids Classes.

  • Fitness, conditioning, and related physical activities.

  • Training memberships, passes, tickets, and packages.

  • Long-stay training programs.

  • Accommodation.

  • Combined training and accommodation packages.

  • Education-related programs where lawfully offered.

  • Visa-support or administrative documentation associated with eligible programs where lawfully offered.

  • Online booking, membership, and customer services.

  • Use of designated facilities and equipment.

  • Other ancillary services offered by The Camp from time to time.

Not every service is available at all times.

The specific service, duration, inclusions, price, eligibility requirements, and applicable conditions are those stated in the relevant booking page, written quotation, booking confirmation, invoice, program description, or other written communication issued or approved by The Camp.
 

2. ELIGIBILITY AND AGE REQUIREMENTS

Customers must provide accurate information concerning their identity, age, and eligibility to participate.

The following age requirements apply to Muay Thai training:

  1. Participants under 6 years of age are not permitted to participate in group classes. They may participate only in an approved Private Lesson and must be accompanied by a parent or legal guardian while on the premises.

  2. Participants aged 6 to 12 may participate only in designated Kids Classes and are not permitted to participate in regular adult group classes.

  3. Participants aged 13 and above may participate in regular group classes, subject to trainer assessment, applicable class-level requirements, physical suitability, and management approval.

  4. Eligibility by age does not guarantee admission to an Intermediate or Advanced class.

  5. The Camp may refuse, restrict, modify, or stop participation where reasonably necessary for safety, suitability, maturity, experience, health, conduct, equipment, or operational reasons.

Where a participant is a minor, a parent or legal guardian may be required to complete registration, accept these Terms, sign the applicable Waiver, provide required consent, and provide any legally required consent concerning the minor's Personal Data.
 

3. BOOKINGS AND CONTRACT FORMATION

A booking request is not confirmed until The Camp has accepted the booking and any required payment has been successfully received or otherwise expressly approved.

A booking may be confirmed through:

  • The Camp's website.

  • An online booking system.

  • Membership or gym-management software.

  • A payment link.

  • Email.

  • Authorized electronic communication.

  • An invoice or receipt.

  • Another booking method expressly authorized by The Camp.

The Camp may refuse a booking before confirmation where reasonably necessary, including because of:

  • Lack of availability.

  • Incorrect pricing or information.

  • Safety concerns.

  • Age or eligibility restrictions.

  • Previous serious misconduct.

  • Fraud or suspected payment fraud.

  • Incomplete documentation.

  • Failure to satisfy requirements of a particular program.

  • Operational restrictions.

  • Legal or regulatory restrictions.

Once a booking has been confirmed, the Customer is responsible for reviewing the booking details and promptly informing The Camp of any error.
 

4. PRICES, FEES AND TAXES

Prices are those displayed or communicated at the time of purchase unless there is an obvious error.

Different products, memberships, packages, programs, accommodation types, booking periods, seasons, promotions, or customer categories may have different prices.

Unless expressly stated otherwise, additional services, rentals, equipment, transportation, food, beverages, visa-related costs, government fees, or other ancillary items are not included.

Applicable taxes will be charged where required by law.

Certain services may be VAT-exempt or subject to different tax treatment under applicable Thai law.

Where payment is made in a currency other than the currency charged by The Camp, exchange rates, currency-conversion charges, and foreign-transaction charges imposed by banks, card issuers, payment processors, or other third parties are the Customer's responsibility.
 

5. PRICE CHANGES

The Camp may change its prices at any time for future purchases.

A price change will not normally affect a confirmed and fully paid booking already accepted by The Camp.

Promotional prices, discounts, legacy prices, membership rates, or special offers may be limited by date, customer category, availability, quantity, or other stated conditions.

A Customer is not entitled to a previous price merely because that price was available during an earlier visit, membership period, inquiry, or purchase.

Where a genuine pricing, typographical, technical, or system error has occurred, The Camp may correct the error before providing the affected service.

Where a confirmed booking is affected by a material pricing error, The Camp will deal with the matter reasonably and in accordance with applicable law.
 

6. PAYMENTS

Payment must be made using a payment method accepted by The Camp.

Depending on the service, full payment or a specified deposit may be required before:

  • A booking is confirmed.

  • A place is reserved.

  • Accommodation is secured.

  • Administrative work begins.

  • Documentation is prepared.

  • A program is activated.

Customers must use a payment method they are legally authorized to use.

Third-party payment processors may process card or online payments.

The Camp may request reasonable verification where a transaction appears fraudulent, unauthorized, unusually high-risk, or inconsistent with the Customer's information.

A payment is not considered complete until it has been successfully received and cleared.

Bank fees, international-transfer fees, exchange-rate costs, card charges, or third-party payment charges are the Customer's responsibility unless expressly stated otherwise.

Where permitted by applicable law and the applicable payment provider, payment-processing charges already incurred may be non-refundable.
 

7. TRAINING PACKAGES AND MEMBERSHIPS

Training memberships, passes, tickets, packages, and session entitlements are personal to the registered participant.

They may not be:

  • Shared.

  • Resold.

  • Transferred.

  • Assigned.

  • Exchanged between participants.

  • Used by friends, family members, or third parties.

unless The Camp expressly approves otherwise in writing.

Standard short-stay group-training packages are sold according to the session structure stated at the time of purchase.

Unless a particular product, membership, or long-stay program expressly states otherwise, The Camp's standard group-training packages are based on either:

  • 2 training sessions per day; or

  • 4 training sessions per day.

A participant may voluntarily attend fewer sessions than included in the purchased package.

Voluntarily skipping a session does not convert the unused session into cash, a refund, future credit, extension, replacement session, or other entitlement unless expressly provided under an applicable written policy.

Long-stay, education-related, visa-related, membership, or other special programs may instead be based on a stated total number of lessons or sessions.

Where a specific program has separate written terms, those program-specific terms apply to that program.
 

8. PACKAGE VALIDITY AND UNUSED SESSIONS

Training passes, memberships, packages, and other entitlements must be used within the validity period stated at purchase.

Unused sessions or days expire at the end of the applicable validity period unless:

  • A written product policy provides otherwise.

  • The Camp expressly approves an extension in writing.

  • Applicable law requires otherwise.

Failure to attend, personal scheduling difficulties, travel, illness, injury, changes of plan, or voluntary non-use do not automatically extend a package.

Any discretionary extension granted in one case does not create an entitlement to an extension in another case.
 

9. CLASS SCHEDULES AND TRAINERS

Class schedules, training times, trainers, training areas, class formats, and other operational arrangements may change.

The Camp does not guarantee that a particular trainer will teach a particular class or Private Session unless expressly confirmed in writing.

Trainer substitutions, reasonable timetable adjustments, class combinations, changes of training area, and comparable operational changes do not by themselves constitute cancellation or non-performance of the purchased service.

Participants are responsible for checking current schedules.

Participants who arrive late may be refused participation where joining the class would be unsafe, disruptive, or operationally impractical.
 

10. CLASS LEVELS

Beginners are not permitted to join Intermediate or Advanced classes.

Participants seeking to join Intermediate or Advanced classes must have:

  • Sufficient Muay Thai experience.

  • Appropriate physical fitness.

  • Required protective equipment.

  • Approval from the trainer or management.

Participation in a particular class level is not an automatic entitlement.

The Camp has the right to determine class suitability.

A participant may be moved to another class or refused participation where the trainer or management reasonably considers the participant's experience, fitness, conduct, equipment, skill level, or safety unsuitable for the requested class.

Detailed training and safety requirements are contained in the applicable Waiver and Code of Conduct.
 

11. PRIVATE SESSIONS

Private Sessions are subject to availability and confirmation.

A booking for a Private Session is for the date, time, duration, trainer allocation, and number of participants confirmed by The Camp.

Private Sessions may not be transferred to another person without prior approval.

Any applicable cancellation or rescheduling entitlement will be stated through the booking process, booking confirmation, or other written communication applicable to the booking.

Customers are responsible for reviewing those conditions before confirming the booking.

Where an applicable cancellation deadline is stated, late cancellation, failure to attend, or failure to cancel within that period may result in the loss of the Private Session without refund or credit.

Late arrival does not automatically extend the scheduled end time.

Sparring during a Private Session is not automatically permitted.

Any sparring must comply with the Waiver and The Camp's safety requirements, including:

  • Prior management approval.

  • Direct supervision by an authorized trainer.

  • Approved and properly fitted headgear.

  • Any other protective equipment required by the trainer or management.
     

12. CANCELLATIONS, REFUNDS AND CREDITS

Except where:

  • Applicable law requires otherwise; or

  • A specific written booking, promotion, or program policy expressly provides otherwise,

payments made to The Camp are generally non-refundable once the applicable service or booking has been purchased or confirmed.

The following circumstances do not automatically create a right to a refund:

  • Illness.

  • Injury.

  • Change of mind.

  • Personal circumstances.

  • Family emergencies.

  • Work commitments.

  • Travel-plan changes.

  • Flight changes, delays, or cancellations.

  • Visa or immigration issues unrelated to a specific written visa-refusal remedy.

  • Failure to attend.

  • Late arrival.

  • Early departure.

  • Voluntary cessation of training.

  • Failure to use purchased services.

Where The Camp chooses to provide a credit, extension, rescheduling arrangement, freeze, transfer, or other accommodation, that arrangement is discretionary unless required by applicable law or expressly promised in applicable written terms.

A discretionary exception does not establish a general policy or precedent.

Any credit issued by The Camp:

  • Has no cash value unless expressly stated otherwise.

  • Must be used within its stated validity period.

  • Is personal and non-transferable unless expressly approved.

  • Is subject to availability and the terms applicable when redeemed.

Where applicable Thai law grants a mandatory cancellation, cooling-off, withdrawal, refund, or other consumer right in connection with an online, distance, direct-marketing, or other transaction, that mandatory right prevails over any inconsistent provision of these Terms.

Nothing in this section limits any consumer right that cannot legally be excluded or restricted.
 

13. NO-SHOWS AND FAILURE TO USE SERVICES

A Customer who fails to attend a booked class, Private Session, accommodation reservation, or other scheduled service without an applicable cancellation or rescheduling entitlement may lose that service without refund or credit.

The Camp is not required to provide replacement sessions, additional days, extensions, or future credits merely because a Customer chooses not to attend or use a purchased service.
 

14. ACCOMMODATION

Where accommodation is purchased from The Camp, the Customer agrees to comply with:

  • The applicable booking confirmation.

  • Check-in and check-out requirements communicated at booking or check-in.

  • Occupancy limits.

  • Access requirements.

  • Safety and security rules.

  • Applicable accommodation or house rules communicated by The Camp.

  • Reasonable staff instructions.

Current check-in and check-out requirements are those communicated through the applicable booking channel or at check-in.

Late check-out is subject to:

  • Availability.

  • Prior approval.

  • Any applicable late check-out charge.

Guests must provide identification or other information reasonably required for check-in, security, immigration reporting, or legal compliance.

Only authorized registered occupants may stay overnight unless The Camp expressly approves otherwise.

Rooms, furniture, fixtures, keys, access devices, linens, equipment, and other property must be treated with reasonable care.

Guests may be charged the reasonable cost of repairing or replacing property that they intentionally or negligently damage, destroy, lose, or remove, excluding normal wear and tear.

Smoking, unauthorized activities, or other conduct resulting in exceptional cleaning, damage, or remediation costs may result in reasonable additional charges.
 

15. TRAINING AND ACCOMMODATION PACKAGES

Where accommodation and training are sold together as a combined or bundled package, the package is treated as a combined service unless the applicable product terms expressly provide otherwise.

A Customer may not unilaterally separate, transfer, exchange, or convert individual components of a bundled package.

Where a Guest voluntarily checks out or permanently leaves the accommodation before the scheduled end date, the Guest will generally be treated as having relinquished the unused accommodation entitlement from the time of departure.

Where training and accommodation form part of the same bundled product, voluntary early departure may also result in the forfeiture of remaining bundled training rights unless:

  • The applicable written product terms provide otherwise.

  • The Camp expressly agrees otherwise in writing.

  • Applicable law requires otherwise.

A Guest remains free to leave the premises or terminate a stay early.

However, voluntary early departure does not automatically create a refund, credit, extension, transfer, or future entitlement.
 

16. DAMAGE, EXTRA CLEANING AND LOST PROPERTY

Customers are responsible for loss or damage caused by their intentional or negligent acts.

The Camp may charge reasonable and properly documented costs for:

  • Damaged property.

  • Lost keys or access devices.

  • Missing equipment.

  • Extraordinary cleaning caused by misuse.

  • Unauthorized removal of property.

  • Other direct loss caused by a Customer's intentional or negligent conduct.

Normal wear and tear is excluded.

Guests are responsible for securing their own personal property.

To the maximum extent permitted by applicable law, The Camp is not responsible for unattended, unsecured, forgotten, misplaced, or lost personal belongings where the loss is not legally attributable to The Camp.
 

17. VISA, IMMIGRATION AND EDUCATION-RELATED PROGRAMS

This Section applies only where The Camp lawfully offers an eligible training, education-related, visa-support, or associated administrative program.

Where such a program is offered, The Camp's role is limited to the training, administrative support, and documentation expressly described in the applicable program terms.

The Camp does not control:

  • Embassies.

  • Consulates.

  • Immigration authorities.

  • Ministries.

  • Government departments.

  • Visa-processing centres.

  • Border officials.

  • Other competent governmental authorities.

The decision to grant, refuse, cancel, extend, revoke, or impose conditions on any visa, extension, immigration status, or governmental permission is made by the relevant authority.

The Camp does not guarantee approval of any visa, extension, immigration permission, or governmental application unless a specific written program term expressly provides a defined contractual remedy following refusal.

Information provided by The Camp concerning visa or immigration procedures is administrative information based on available requirements and The Camp's operational experience.

It does not constitute independent legal or immigration advice.

Applicants are responsible for:

  • Providing complete and accurate information.

  • Providing authentic documents.

  • Meeting application and reporting deadlines.

  • Maintaining a valid passport.

  • Complying with immigration requirements.

  • Attending required appointments.

  • Responding to governmental requests.

  • Ensuring that their immigration status remains lawful.

The Camp may refuse to prepare, issue, submit, support, or continue documentation where:

  • Required information is incomplete.

  • Information appears false or misleading.

  • Documentation appears fraudulent.

  • The applicant does not satisfy program requirements.

  • Required payment has not been completed.

  • Continued assistance may violate law, regulation, licence conditions, educational requirements, or governmental instructions.

Any visa-program-specific refund arrangement, refusal guarantee, processing charge, payment condition, documentation requirement, attendance condition, or other term stated in the applicable written program terms takes priority over the general provisions of these Terms for that program.
 

18. TRAVEL, PASSPORTS, INSURANCE AND ENTRY REQUIREMENTS

Customers are responsible for arranging and maintaining:

  • Passports.

  • Visas.

  • Entry permission.

  • Re-entry permission.

  • Travel documents.

  • Flights.

  • Transportation.

  • Travel insurance.

  • Medical insurance.

  • Accident insurance.

  • Other documents or insurance required for their travel or activities.

Participants are strongly encouraged to ensure that their insurance specifically covers Muay Thai, combat sports, physical training, and any other activities in which they intend to participate.

The Camp is not responsible for losses arising from a Customer's failure to satisfy immigration, travel, passport, insurance, airline, or transportation requirements, except to the extent liability cannot legally be excluded.
 

19. TRAINING WAIVER AND ASSUMPTION OF RISK

Participation in Muay Thai or other physical training may require completion and acceptance of The Camp's current Training Waiver, Assumption of Risk, Release of Liability & Code of Conduct.

The Waiver forms a separate but related agreement governing matters including:

  • Physical-training risks.

  • Health declarations.

  • Safety requirements.

  • Sparring.

  • Protective equipment.

  • Children and parental supervision.

  • Class eligibility.

  • Participant conduct.

  • Training-related liability.

  • Other safety matters.

A participant who refuses to complete a required Waiver may not participate in training.

Nothing in these Terms replaces or reduces the requirements contained in the Waiver.
 

20. HOUSE RULES AND CODE OF CONDUCT

All Customers, participants, guests, members, parents, guardians, and visitors must comply with The Camp's applicable:

  • House rules.

  • Safety rules.

  • Training rules.

  • Code of Conduct.

  • Access rules.

  • Reasonable staff and management instructions.

The Camp may refuse service, remove a person from a class or facility, suspend access, terminate training privileges, terminate a membership, or permanently prohibit a person from entering The Camp where reasonably necessary because of:

  • Serious or repeated rule violations.

  • Unsafe behaviour.

  • Unauthorized sparring or fighting.

  • Violence or threats.

  • Harassment.

  • Sexual harassment.

  • Discriminatory abuse.

  • Theft.

  • Property damage.

  • Intoxication.

  • Illegal drug activity.

  • Serious disruption.

  • Unauthorized access.

  • Refusal to comply with reasonable safety instructions.

  • Conduct creating a material risk to guests, staff, trainers, property, or operations.

Where services are terminated because of the Customer's material breach or serious misconduct, unused services may be forfeited to the maximum extent permitted by applicable law.
 

21. CUSTOMER RESPONSIBILITY FOR INFORMATION

Customers must provide information that is accurate, current, complete, and not misleading.

Customers must not:

  • Impersonate another person.

  • Use another person's payment method without authorization.

  • Provide false identity information.

  • Provide falsified visa or government documents.

  • Misrepresent age or eligibility.

  • Deliberately conceal information where disclosure is reasonably required for safety or the requested service.

The Camp may refuse, suspend, or terminate services where material information is false, fraudulent, misleading, or intentionally withheld.
 

22. SERVICE CHANGES, CLOSURES AND OPERATIONAL INTERRUPTIONS

The Camp may make reasonable operational changes to services, including changes involving:

  • Class schedules.

  • Trainers.

  • Training areas.

  • Equipment.

  • Room allocation.

  • Facility access.

  • Operational hours.

  • Program sequencing.

where reasonably necessary.

The Camp may temporarily suspend, restrict, relocate, or modify services because of:

  • Safety concerns.

  • Repairs.

  • Maintenance.

  • Utility failures.

  • Severe weather.

  • Air-quality or environmental conditions.

  • Government orders.

  • Public-health measures.

  • Security incidents.

  • Natural disasters.

  • Labour disruption.

  • Transportation disruption.

  • Other circumstances outside The Camp's reasonable control.

Where reasonably possible, The Camp will seek to minimize material disruption.

Where The Camp is materially unable to provide a confirmed paid service, the available remedy will be determined in accordance with the applicable booking terms and mandatory law and may include, where appropriate:

  • Rescheduling.

  • Replacement service.

  • Credit.

  • Refund of the affected portion.

Reasonable timetable adjustments, trainer substitutions, or comparable operational changes are not normally considered a material failure to provide the service.
 

23. FORCE MAJEURE

To the maximum extent permitted by applicable law, The Camp is not liable for delay, interruption, or failure caused by circumstances beyond its reasonable control.

Such circumstances may include:

  • Natural disasters.

  • Floods.

  • Fires.

  • Storms.

  • Earthquakes.

  • Epidemics.

  • Pandemics.

  • Government restrictions.

  • War.

  • Civil disturbance.

  • Terrorism.

  • Transportation disruption.

  • Infrastructure failure.

  • Prolonged utility outage.

  • Similar events outside The Camp's reasonable control.

Nothing in this section removes any mandatory consumer remedy that cannot legally be excluded.

Except where applicable law requires otherwise, The Camp is not responsible for consequential third-party travel costs such as replacement flights, external hotels, visas, transportation, or other expenses merely because a service is interrupted.
 

24. WEBSITE AND ONLINE ACCOUNTS

Customers who create an online account are responsible for maintaining the confidentiality and security of their login credentials.

Customers must promptly notify The Camp if they reasonably believe that their account has been accessed without authorization.

Customers must not:

  • Attempt unauthorized access to the Website or systems.

  • Interfere with Website security.

  • Introduce malware or harmful code.

  • Unlawfully scrape or extract data.

  • Use automated systems in a manner that materially disrupts the Website.

  • Use the Website for fraudulent or unlawful purposes.

The Camp may suspend or disable an account where reasonably necessary to protect security, investigate suspected fraud, or address a material breach of these Terms.
 

25. WEBSITE INFORMATION AND ERRORS

The Camp seeks to keep information accurate and current but does not guarantee that every Website page will be free from typographical errors, outdated information, technical errors, or temporary inaccuracies.

The Camp may correct errors and update information.

Material booking information contained in a confirmed written booking or transaction record will generally take priority over general Website information applicable to the same purchase, subject to mandatory law.

Images of rooms, facilities, training, equipment, or other services are illustrative unless expressly stated to represent a specific guaranteed item.
 

26. INTELLECTUAL PROPERTY

Unless otherwise stated, Website content and materials created or owned by The Camp, including:

  • Names.

  • Logos.

  • Branding.

  • Text.

  • Graphics.

  • Photographs owned by The Camp.

  • Video owned by The Camp.

  • Training or educational materials.

  • Website design.

  • Promotional materials.

are owned by or licensed to The Camp and may be protected by applicable intellectual-property law.

Customers may view and use Website content for personal, non-commercial purposes associated with evaluating or using The Camp's services.

No person may reproduce, commercially exploit, republish, falsely represent, or distribute protected content without permission where such permission is legally required.

Nothing in this section restricts lawful quotation, criticism, review, news reporting, or other use permitted by applicable law.
 

27. THIRD-PARTY SERVICES

The Camp may use or link to independent third-party services including:

  • Payment processors.

  • Booking platforms.

  • Membership systems.

  • Communication services.

  • Cloud services.

  • Maps.

  • Social-media platforms.

  • Transportation providers.

  • External websites.

Independent third parties may have their own terms and privacy policies.

The Camp is not responsible for the independent acts or omissions of a third party that The Camp does not control, except where applicable law provides otherwise.

Use of a third-party service may require the Customer to accept that provider's own contractual terms.
 

28. PRIVACY AND PERSONAL DATA

Personal Data is handled in accordance with The Camp's Privacy Policy and applicable Thai data-protection law.

Depending on the service, Personal Data may be processed for purposes including:

  • Registration.

  • Booking.

  • Payment.

  • Membership administration.

  • Training safety.

  • Accommodation.

  • Emergency response.

  • Security.

  • CCTV.

  • Legal compliance.

  • Customer communications.

  • Eligible visa-program administration.

  • Other purposes described in The Camp's Privacy Policy.

Where legally required, separate consent or explicit consent will be obtained, including where appropriate for Sensitive Personal Data such as health information.

Acceptance of these Terms does not by itself constitute consent for every processing activity where separate consent is legally required.
 

29. ELECTRONIC COMMUNICATIONS, CONTRACTS AND SIGNATURES

Customers agree that bookings, confirmations, invoices, policies, notices, agreements, signatures, initials, checkbox selections, and other records may be created, transmitted, accepted, and maintained electronically.

To the extent permitted by applicable law, an electronic acceptance, electronic signature, or other reliable electronic action intended to evidence agreement may have the same legal effect as a handwritten signature or paper acceptance.

Customers are responsible for providing accurate contact information and maintaining reasonable access to the email address, telephone number, membership account, or communication channel used for their booking.
 

30. CHARGEBACKS AND PAYMENT DISPUTES

Customers should contact The Camp promptly if they believe that a payment, charge, or refund has been processed incorrectly.

Nothing in these Terms prevents a Customer from exercising a lawful right to dispute a payment with their bank, card issuer, or payment provider.

Where a chargeback or payment dispute occurs, The Camp may provide the payment processor, bank, card network, or other relevant party with reasonably relevant evidence including:

  • Booking records.

  • Attendance records.

  • Communications.

  • Signed agreements.

for the purpose of establishing whether the charge was valid.

Fraudulent or knowingly false chargebacks may result in suspension of future services and recovery action to the extent permitted by law.
 

31. LIMITATION OF LIABILITY

Nothing in these Terms excludes liability that cannot legally be excluded under applicable Thai law.

Subject to that limitation, The Camp is not responsible for indirect or consequential losses that were not reasonably foreseeable or that arise from matters outside The Camp's reasonable control.

Customers remain responsible for:

  • Their own travel arrangements.

  • Personal decisions.

  • Voluntary non-attendance.

  • Personal property.

  • Compliance with applicable travel requirements.

  • Compliance with applicable immigration requirements.

Liability specifically relating to physical participation in training is additionally governed by the applicable Waiver.
 

32. CHANGES TO THESE TERMS

The Camp may update these Terms to reflect:

  • Changes in services.

  • Operational changes.

  • Changes in law or regulation.

  • Changes in payment or booking systems.

  • Safety requirements.

  • Other legitimate business requirements.

The current version and effective date will be made available through an appropriate official channel.

Changes generally apply prospectively.

A material change will not retrospectively remove a contractual or statutory right relating to a completed or confirmed purchase where applicable law does not permit that result.

Where new consent is legally required, continued Website use alone will not substitute for legally valid consent.
 

33. ORDER OF PRECEDENCE

Where different documents apply to the same service and there is an inconsistency, the following order will generally apply, subject always to mandatory applicable law:

  1. Mandatory provisions of applicable law.

  2. Specific written terms expressly applicable to the particular booking, program, promotion, or service.

  3. A confirmed booking, written quotation, invoice, or confirmation identifying the purchased service.

  4. The Training Waiver, Assumption of Risk, Release of Liability & Code of Conduct for matters specifically concerning physical participation, safety, and conduct.

  5. These Terms & Conditions.

  6. General Website descriptions or promotional information.

The Privacy Policy governs Personal Data matters and operates alongside these Terms rather than being replaced by them.
 

34. ENTIRE AGREEMENT

These Terms, together with the documents expressly applicable to the relevant service, constitute the agreement between the Customer and The Camp concerning that service.

They supersede prior oral representations concerning the same subject matter to the extent permitted by law.

No trainer, employee, representative, agent, or other person may modify a material contractual term on behalf of The Camp unless authorized to do so and the modification is confirmed in writing.
 

35. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted, restricted, or severed only to the extent necessary.

The remaining provisions will continue in effect to the maximum extent permitted by law.
 

36. NO WAIVER

A failure or delay by The Camp in enforcing a contractual right does not automatically constitute a permanent waiver of that right.

An exception granted to one Customer or on one occasion does not create a continuing obligation to grant the same exception in the future.
 

37. GOVERNING LAW AND JURISDICTION

These Terms and any agreement governed by them shall be governed by the laws of the Kingdom of Thailand.

Any dispute shall be subject to the courts or other competent authorities of Thailand in accordance with applicable law.

Nothing in this section prevents a consumer from exercising any mandatory right to apply to a competent consumer-protection, regulatory, or governmental authority.
 

38. LANGUAGE

These Terms are currently provided in English.

Where a translation is provided, it may be provided for convenience unless expressly stated otherwise.

Where applicable Thai law requires a contractual provision or document to be provided in Thai, the legally required Thai-language provision or document shall apply to the extent required by law.

Subject to mandatory legal requirements, where a convenience translation conflicts with the official English version, the English version will be used to interpret The Camp's intended contractual wording.
 

39. ACCEPTANCE OF THESE TERMS

By purchasing, booking, accessing, or using a service covered by these Terms, I acknowledge that:

  • I have had the opportunity to review the applicable terms before purchase or participation.

  • I understand that different services may have specific additional conditions.

  • I agree to comply with applicable booking conditions and policies.

  • I understand that training participation may require a separately accepted Waiver.

  • I understand that payments are generally non-refundable except where applicable law or specific written terms provide otherwise.

  • I understand that mandatory consumer cancellation or refund rights, where applicable, are not excluded by these Terms.

  • I understand that voluntary failure to attend or early departure does not automatically create a refund or credit.

  • I understand that visa or immigration approval is determined by governmental authorities and cannot be guaranteed by The Camp except for any specific remedy expressly stated in applicable written program terms.

  • I agree to comply with reasonable safety, conduct, access, and operational rules.

  • I agree that electronic acceptance may evidence my agreement to the extent permitted by applicable law.
